الملخص :

ظهرت فكرة القانون الجنائي الأعمال كقانون عقوبات خاص بفئة معينة من الأشخاص هم رجال الأعمال، نتيجة اقتناع الفقه القانوني في التشريعات المعاصرة، بوجوب التفرقة في العقاب بين المجرم التقليدي ومجرم الأعمال، الذي يرتكب جرائم ترتبط مباشرة بمجال عمله وهو الأعمال والمعاملات التجارية، من منطلق أنه من الأشخاص المساهمين في نهضة الاقتصاد القومي، غير أنه ينحرف بسلوكاته الشاذة عن الأهداف النبيلة للتجارة، فيقع في هوة الجريمة لتحقيق مصالح غير مشروعة في هذا النطاق، مما يضر بالثقة والائتمان المطلوبين  في المعاملات التجارية، وهو ما يستدعي التصدي لهذه السلوكات المنحرفة ولكن بعقوبات تأخذ بعين الاعتبار نوعية هذا الإجرام الذي يختلف عن الإجرام التقليدي، مما دفع بالفقة إلى القول بوجوب إيجاد نوع من القواعد القانونية خاصة بهده الفئة من الجناة، اصطلح عليها بالقانون الجنائي للأعمال.

Abstract:

The idea of ​​criminal business law emerged as a penal code specific to a specific category of people, namely businessmen, as a result of the conviction of legal jurisprudence in contemporary legislation, of the necessity of differentiating in punishment between the traditional criminal and the business criminal, who commits crimes directly related to his field of work, which is business and commercial transactions, based on the fact that he is one of the people who contribute to the renaissance of the national economy, but his deviant behaviors deviate from the noble goals of trade, and he falls into the abyss of crime to achieve illegitimate interests in this area, which harms the trust and credit required in commercial transactions, which requires confronting these deviant behaviors, but with penalties that take into account the type of this crime that differs from traditional crime, which prompted jurisprudence to say that it is necessary to find a type of legal rules specific to this category of criminals, which is called criminal business law.
